When purchasing or renting a property in a gated community or sectional title scheme, make sure to request a copy of the community rules.
Community Life
Rules govern community life by providing a framework for good neighbourliness and harmonious living. The Rules are binding on residents with the aim to safeguard a quality lifestyle. Rules are not meant to be draconian or to impinge on the rights of the individual. Generally rules deal with issues such as general conduct, environmental, construction and security matters, disciplinary processes as well as architectural guidelines. A well-formulated set of rules ensure cohesion in a community.
Governing Documents
Together with the Memorandum of Incorporation, the rules form part of the governing documents.
New owners and tenants are encouraged to read the Memorandum of Incorporation (commonly known as the Constitution or MOI) of a scheme or at least to read the rules to ensure understanding of the obligations of community living. Governing documents are generally available from the real estate agent or on the website of the particular estate or community scheme, alternatively the management office will also have copies available.
Possible restrictions
Many estates have provisions in the MOI and/or Rules dealing with time period restrictions for the completion of construction work on vacant properties. When purchasing an empty stand, make sure to discuss the building time periods with the estate agent and also refer to the applicable governing documents for more information. It is always better to be forewarned. This too would apply if planning to run a business from home, also remember to check the clauses dealing with the ownership of pets. Some sectional title schemes and eco estates might not allow certain pets.
Rules are part and parcel of life in community schemes and provide the guidance for harmonious living.
